Job Description


This function will be responsible for providing professional effective legal support services to the GM Legal Services and Legal Managers as well as provide assistance and advice in all aspects of BMW’s operations to all BMW’s divisions, departments and subsidiaries to enable BMW to achieve its overall objectives by (amongst others) maintaining status on contractual actions, preparation, vetting, analysis and negotiation of various contractual instruments and related documents and provide other legal support as needed.

The successful candidate will have the following responsibilities including, but not limited to:

  • Ensuring that governance, compliance and adherence with BMW standard terms and conditions and policies across customer, supplier, marketing, distribution, dealers and financial services business units.
  • Have a sound understanding of laws and regulations impacting BMW SA and the industry including (but not limited to):
    • Consumer law
    • Data privacy law
    • Competition law
    • Intellectual property law
    • Company law
    • Cyber law
    • Labour law
  • Prepare draft legal opinions in response to queries raised, following general instructions given by Manager/s in respect of BMW SA or BMW Financial Services.
  • Perform preliminary review of the legal aspects of project proposals, draft agreements, correspondence, and other texts and provide appropriate comments to the corresponding Manager.
  • Draft or assist in the drafting of legal documents
  • Draft legal memoranda and other legal documents including administrative contracts and agreements such as contracts of engagement of suppliers, customers, consultants, and contracts awarded for the procurement of goods or services.
  • Prepare and follow up on filings before national entities to establish, maintain, and protect the intellectual property and other legal commercial rights
  • Prepare draft recommendations concerning intellectual property and commercial issues.
  • Assist in the preparation of briefs to represent in proceedings before appeal bodies and administrative tribunals as well as other judicial or quasi-judicial bodies.
  • Prepare background materials, reports, papers, and other documents as requested by the Manager/s.
  • Assist in the preparation, negotiation and finalisation of new and updated agreements forms and precedents, contracts and tender documents or other documents of legal or quasi-legal consequence in compliance with BMW group policies, applicable laws and regulations.
  • Assist with general litigation briefing external attorneys and counsel in a cost-effective and timeous manner with minimal interference on BMW’s operations.
  • Assist in liaison with key stakeholders such as attorneys and outside counsel, NAAMSA Legal Forum, government departments, BMW AG legal and other applicable departments and stakeholders within and outside of BMW SA (Pty) Ltd. Maintain and provide record of outside counsel and attorneys use and cost.
  • Report on new and proposed legislation and legal development and supporting compliance therewith by the BMW Group including conducting business impact assessments of new legislation and advising business to mitigate risks.
  • Assist Manager/s with new business projects and deal structuring.
  • Provide input to Manager/s on new bills and other forms of legislation through strategic forums.
  • Assist Manager/s with various company secretarial duties for BMW South Africa (Pty) Ltd and BMW Financial Services.
  • Cross-functional and cross-border working capability across all BMW Group companies.

Education & Competencies


  • A minimum of BA/B.C om LLB / LLB or equivalent law degree from a recognised University and an admitted Attorney or Advocate with completion of Professional Legal Training (as applicable).
  • A minimum 3 years experience subsequent to completion of articles or pupilage and preferably within a multinational organization/s will be advantageous.
  • Sound knowledge of commercial law as well as consumer protection, company and corporate laws and governance, intellectual property law, data privacy laws and laws related to financial service providers.
  • Sound knowledge and experience in civil and criminal litigation process and procedure.
  • Sound commercial legal drafting skills.
  • High level of integrity with a desire to do the right thing and maintain ethical standards within applicable laws.
